1) Regarding the woman’s deficiency + two witnesses

Narrated Abu Sa`id Al-Khudri:

The Prophet (ﷺ) said, "Isn't the witness of a woman equal to half of that of a man?" The women said, "Yes." He said, "This is because of the deficiency of a woman's mind."

Questioner:

May Allah bless you and may He bring about benefit through your knowledge. How can we respond to the following doubt: "How can the woman be described with deficiency/reduction in her religion, even though she obeyed the Command of Allah? Because it is Allah Who ordered her to stop praying and fasting during the menstruation. And she has no control over this. Since Allah decreed this affair for the daughters of Adam (i.e. the women). And even if she was to pray and fast during her menstruation, then this would be invalid. So why has she been described with deficiency/reduction in her religion for something she has no control over?"

Shaykh Arafat Ibn Hasan Al-Muhammadi حفظه الله:

The speech regarding the deficiency in [the woman's] religion, which has been narrated in the hadith, this is in terms of the reality, i.e. this does not mean that the woman is sinning or that she deserves Hellfire due to that. This is not the meaning. We have to understand what the Prophet ﷺ  meant when he spoke about the deficiency in her religion. This is in terms of reality. This is why I ask this woman: Are you equal to the man, when you stop praying during menstruation? Every month, you stop praying for a period of seven days. For some women it may even be ten days, or even half the month - although this is rare. She doesn't pray during half the month! So this indicates that she does not pray for about half her life. So in terms of the reality: are you more deficient than the man, or are you equal to the man who never stops praying? Without any doubt, she will answer:

"Of course I am more deficient." In that case we say: that is exactly what the Prophet ﷺ meant! The intent of this is not that the woman, if she is deficient in her religion due to her not praying (during menses), that she is sinning or that she will be in the Fire. This is not correct! There are many pious woman that worship and obey [their Lord]. And take the example of the wives of the Prophet and the female Companions. This is in terms of deficiency/reduction in her religion. Likewise, with regards to her being deficient in her intellect/reason ("aql). What is intended by this, is that which relates to giving testimony (being a witness). Because the woman is not equal to the man in terms of intellect, precision and memorisation. That is because, subhan’allah, the woman is busy with many affairs. These affairs could be a reason that her memorisation, accuracy and precision are less, due to which she doesn't have the same precision as a man. This is in terms of the aşl (origin), in terms of the general rule. However, there can be a woman that has a better memorisation than some men. So therefore we must have a correct understanding of what deficiency/ reduction in intellect means. Because some people might think that this means that the woman is stupid, and that stupidity is the aşl (origin) of the woman. That is not correct! That is not what is meant. It is for this reason that this hadith became problematic for those people who have this [false] understanding. What is intended by this [hadith] is as mentioned in the verse: {..so that if one of them (two women) errs, the other can remind her...} (2:282). Forgetfulness. A woman can be busy with many affairs such as nurturing the children, staying with the children, pregnancy, giving birth, breastfeeding and many things. So due to that, her precision in [remembering] certain information will be lacking. Thus Allah ordered to get two women to witness. (see 2:282). The woman is only blamed if she opposes the Legislation of Allah, if she disobeys and if she opposes the textual evidence (from the Book or Sunnah). This is why it says in the hadith: «I looked into Paradise and saw that the majority of its people were the poor, and I looked into the Fire and found that the majority of its people were women.» Why don't you ask about this hadith? Why don't you ask, "Why are we the majority of the inhabitants of the Fire?" So here we say: because the Prophet ﷺ clarified the reason for that when he referred to the woman being ungrateful towards her husband. This is what the woman is blamed for. For being ungrateful towards her husband. She is not blamed for not praying during her menstruation, nor [is she blamed] for the weakness in her memory because of which two female witnesses are needed. She is not blamed for that. However, she is blamed for that which is mentioned in the text (the hadith): «Verily, you are ungrateful towards your husbands.» So we say to this woman and to the other women: Fear Allah, as he ﷺ said. He (the Prophet) has warned against this affair. And (he clarified) why there are so many women in the Fire: because she is ungrateful towards her husband. That is why he ﷺ said: «If one of them (men) is [always] good towards her (the wife), and then when he wrongs her (one time) she says: "I have never seen any good from you!"» This is what the woman is blamed for. On the other hand it says in Sahih Muslim that the man will have two wives [In Paradise] from the woman of this worldly life (dunya). On the other hand it says in Sahih Muslim that the man will have two wives [In Paradise] from the woman of this worldly life (dunya). They said that this proves that there will be many women in Paradise. Because the man will have many women from al-Hür al-'in, as mentioned in the authentic hadith. But in Sahih Muslim it is mentioned that each man will have two wives from the women of this dunyā.  Thus some people used this hadith as proof that there will be more women (than men) in Paradise. So then it is said that there will be more women (than men) in the Fire, and also more women (than men) in Paradise. So the pure woman that fears Allah, prays her five prayers, guards her fard (obligation), obeys her husband and fasts her month (Ramadān); she is not blamed! And if she stops praying due to her menses, then she has obeyed the Command of Allah, as mentioned in the question. And if she is forgetful due to [being busy with] her worldly affairs, then this doesn't harm her. Because this relates to memorisation and precision, so she is not blamed for that. So Allah ﷻ has given each person his/her right. So there is no doubt that, in general, the woman is less than the man as it relates to managing affairs and risk management. Allah has created the woman upon that. She is female. i.e. in terms of her femininity she is not equal to the man. As Allah said: {"and the male is not like the female.."} (3:36)
